Business Consulting — Terms of Service
Provider: VolleyInstinct (“we,” “our,” “us”)
Client: The individual submitting payment and purchasing Business Consulting (“you,” “your,” “client”).
By purchasing Business Consulting, you agree to the following Terms of Service.
If you do not agree, do not purchase.
1. Service Overview: Business Consulting
Business Consulting is a recurring subscription service offered in 1-month, 3-month, or 6-month terms. Regardless of the billing plan selected, all deliverables are allocated strictly on a per-month basis. A “monthly cycle” begins on the date of your initial purchase and resets on that same calendar date each month (e.g., a purchase on the 5th means your cycle resets on the 5th of every month). If your purchase falls on a date that does not occur in a subsequent month (such as the 31st), your cycle will reset on the last calendar day of that month. During each active monthly cycle of your term, VolleyInstinct provides:
- Strategic Action Plans: Delivery of one (1) custom business document detailing clear, actionable items for your business.
- VIP Support Chat: Access to a private, dedicated Google Space for direct messaging and asynchronous support from the VolleyInstinct team.
- Strategy Calls: Up to two (2) business strategy calls. Calls must be requested via chat or email at least one (1) week in advance.
- Custom Project Builds (Upon Request): The Client may request VolleyInstinct to build custom business assets (e.g., Analytics Dashboards, Automations, Sales SOPs, Websites, etc.). Execution of these projects is subject to mutual written agreement regarding the project scope, timeline, and any applicable additional fees.
Use-It-Or-Lose-It Policy: To ensure consistent momentum, all allocated calls and documents must be utilized within their respective monthly cycle. Unused calls, documents, or deliverables do not roll over into the following month, regardless of the overall length of your subscription.
2. Pricing & Purchasing
- The pricing amount may vary and will be clearly displayed at checkout at the time of purchase.
- This service is a recurring subscription that will continue to charge the card on file unless it is cancelled.
- When purchasing, the client agrees that they are above 18 years of age and they are the responsible cardholder.
3. Refund Policy
We offer a 14-day money-back guarantee for our Business Consulting services. If you determine that our services are not the right fit within the first 14 days of your engagement, you may request a full refund of your initial fees.
Because our consulting is highly customized and requires us to dedicate a significant amount of time, specialized resources, and upfront effort to your specific business, we cannot extend this guarantee beyond this initial timeframe.
After the 14-day period has expired, we enforce a strict no-refund policy. By accepting the terms of this Agreement and continuing our services past the initial 14 days, you agree and understand that you are foregoing the right to claim any refund of fees paid for Business Consulting offered by VolleyInstinct.
4. Cancellation Policy
You may cancel your subscription at any time by clicking the “Manage Subscription” link provided in your Stripe purchasing email. For further support in this matter, email business@volleyinstinct.com.
Mid-Period Cancellations: We do not offer prorated refunds for partial months. If you cancel in the middle of a billing cycle, you will not be billed again, and you will retain full access to the services until the end of your current paid billing period.
Provider Cancellation & Non-Renewal: VolleyInstinct reserves the right to cancel or decline the renewal of any subscription at the end of the Client's current paid term. In such cases, the Client will receive advance written notice and full service will be honored through the end of the paid billing period.
Termination for Cause: VolleyInstinct reserves the right to immediately terminate this agreement and revoke all access to services, without a refund, if the Client engages in any illegal activities, unethical business practices, or abusive and harassing behavior toward the VolleyInstinct team. We maintain a zero-tolerance policy for unlawful conduct.
5. Client Responsibilities & Communication
To ensure the highest quality of service, you agree and understand that you must actively use the provided VIP Support Chat and business strategy calls to communicate your current business needs, challenges, and feedback to the VolleyInstinct team. You agree to communicate respectfully.
VolleyInstinct relies on your ongoing communication, transparency, and timely responses to craft accurate, effective Strategic Action Plans and custom deliverables.
6. Mutual Confidentiality & Intellectual Property
To foster a transparent and effective consulting relationship, both parties agree to maintain strict confidentiality regarding sensitive information shared during the term of this agreement.
- Client Information: VolleyInstinct agrees that all financial data, internal metrics, employee information, and proprietary business operations shared by the Client will be kept strictly confidential and used solely for the purpose of delivering the agreed-upon consulting services. We will never share, sell, or disclose your private business data to outside parties or competitors.
- VolleyInstinct Intellectual Property: The Client agrees that all Strategic Action Plans, custom projects, and proprietary methodologies provided by VolleyInstinct are for the Client's internal business use only. The Client may not distribute, resell, publish, or share these materials with outside organizations without prior written consent from VolleyInstinct.
- Exceptions: Confidential information does not include data that is already public knowledge, was already in the possession of the party receiving it before this agreement, is required to be disclosed by law, or is shared with the express written consent of both parties.
7. No Guarantee of Results
We make no promises or guarantees regarding your success or income level. Please note that individual successes are influenced by personal abilities, market conditions, and other external factors. We assume no responsibility for decisions made or actions taken based on the service. You agree that you are taking full responsibility for your own success.
8. Amendments & Modifications
This document represents the entire agreement between both parties regarding the services provided. No changes, additions, or modifications to these terms or the scope of work will be considered valid or binding unless they are explicitly agreed upon by both parties in writing. For the purposes of this agreement, valid written consent includes formal email communication or direct written confirmation within the Client's dedicated Google Spaces Chat portal.
9. Governing Law
These Terms are governed by the laws of the State of California.
By purchasing, you confirm that you have read, understood, and agreed to these Terms.
